Welcome to the BlindBottle.com ("BB", "we", "us", or "our") website. By accessing or using our services, you agree to be bound by these Terms and Conditions ("Terms") and our Privacy Policy. If you do not agree with these Terms, please do not use our website or services.

1. Acceptance of Terms

By using this website, you accept these Terms in full. These Terms may be updated by us from time to time without notice. Your continued use after such changes will constitute your consent to the changes.

2. Services

BB provides software products and related services as described on our website. We strive to provide accurate and reliable services, but we make no guarantees regarding the outcomes of our advice or services.

3. Use of Website

  • License: You are granted a limited, non-exclusive, non-transferable license to access and use the website for personal or internal business purposes.

  • Restrictions: You agree not to interrupt or attempt to interrupt the operation of the website in any way. Unauthorized use, reproduction, or distribution of any content for commercial purposes is prohibited.

4. Intellectual Property

All content on this site, including text, graphics, logos, and software, is the property of BB or its content suppliers and protected by United States and international copyright laws.

5. Limitation of Liability

  • Under no circumstances, including, but not limited to, negligence, shall BB, its affiliates, partners, or employees be liable for any direct, indirect, incidental, special, or consequential damages that result from the use of, or the inability to use, the materials on this site.

  • In Pennsylvania, the economic loss doctrine might apply, limiting recovery solely to economic loss in certain circumstances; however, this does not affect the cap on liability as described.

6. Indemnification

You agree to indemnify, defend, and hold harmless BB, its officers, directors, employees, agents, licensors, and suppliers from and against all losses, expenses, damages, and costs, including reasonable attorneys' fees, resulting from any violation of these Terms or any activity related to your account by you or any other person accessing the site through your account.

7. Governing Law

These Terms shall be governed and construed in accordance with the laws of the Commonwealth of Pennsylvania, without regard to its conflict of law principles.

8. Dispute Resolution

Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Pennsylvania. You hereby consent to personal jurisdiction in such courts.

9. Warranty Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

10. Termination

BB may terminate or suspend your access to all or part of the website, without notice, for any conduct that BB, in its sole discretion, believes is in violation of any applicable law or is harmful to the interests of another user, a third-party provider, a service provider, or BB.

11. Miscellaneous

  • If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

  • These Terms constitute the entire agreement between you and BB regarding the use of the website.

Wine Trail Contests

By using the BlindBottle app and participating in a Wine Trail Contest, you agree to be bound by these additional Terms and Conditions.

1. Eligibility

  • The contest is open to individuals who are 18 years of age or older and legal residents of the United States.

  • To participate in wine tasting, participants must be 21 years of age or older, as required by law.

  • Employees of BlindBottle, participating vineyards, and their immediate family members (spouse, parents, siblings, children, and their respective spouses) are not eligible to participate.

  • The contest is void where prohibited by law.

2. How to Enter

  • Register on the BlindBottle app (available for free).

  • Visit participating vineyards and:

    • Taste the "blind flight" of 3-5 wines and rate them using the BlindBottle app (for participants 21+).

    • Scan the QR code at the vineyard to earn points without tasting.

    • Post pictures of your experience on Instagram with and tag Blind.Bottle and the participating venue.

  • Points are earned for each activity (scanning QR codes, and posting on Instagram).

  • Participants may earn points through any combination of these methods.

  • The contest period will run from a start date through an end date. Exact dates will be announced prior to the contest launch and available on the website and signage at the participating venues.

3. Prizes

  • Three (3) cash prizes will be awarded to the participants with the highest total points at the end of the contest period.

  • The total value of all prizes will not exceed One Thousand Dollars ($1,000.00), in compliance with Pennsylvania law.

  • The exact amounts of the prizes will be determined by BlindBottle and disclosed prior to the start of the contest.

  • Prizes are subject to applicable taxes, and winners are responsible for any taxes on the prize value.

4. Winner Selection

  • Winners will be determined based on the total points earned during the contest period by eligible participants.

  • In the event of a tie for any prize, a random draw will be conducted among the tied participants to determine the winner.

  • Decisions of BlindBottle regarding winner selection are final and binding.

5. Notification and Claiming Prizes

  • Winners will be notified via the email associated with their BlindBottle app account within 14 days after the contest end date.

  • To claim the prize, winners must respond to the notification within 30 days and provide any required information, including tax identification, as necessary for prize disbursement.

  • Failure to respond within the specified timeframe may result in forfeiture of the prize, and an alternate winner may be selected at BlindBottle’s discretion.

6. Rights and Ownership

  • By participating in the contest and posting content on Instagram, participants grant BlindBottle a non-exclusive, royalty-free, worldwide, perpetual license to use, display, and reproduce the content and your name for promotional and marketing purposes related to the contest and BlindBottle’s business.

  • Participants represent and warrant that they own or have obtained all necessary rights to the content they post and that such content does not infringe on any third-party rights.

  • Participants must comply with Instagram’s terms of service and community guidelines when posting content for the contest. BlindBottle is not responsible for any actions taken by Instagram regarding participant posts.

7. Disqualification and Exclusions

  • BlindBottle reserves the right to disqualify any participant who:

    • Violates these Terms and Conditions.

    • Engages in fraudulent behavior.

    • Attempts to undermine the legitimate operation of the contest.

  • Incomplete, illegible, or non-compliant entries will be disqualified.

8. Liability and Indemnity

  • By participating, participants release and hold harmless BlindBottle, the participating vineyards, and their respective officers, directors, employees, and agents from any and all liability for any injuries, loss, or damage of any kind arising from or in connection with the contest, use of the app, or the use of any prize.

  • BlindBottle is not responsible for any technical failures, malfunctions, or other issues that may affect participation or prize claiming.

  • Participants are responsible for their own conduct, including safe travel between vineyards.

  • Blind Bottle is not liable for incidents at vineyards or incidents related to alcohol consumption, as this is not required for event participation.

  • Social media posts must comply with the terms and conditions of each respective platform and avoid defamatory content.

9. Modifications and Termination

  • BlindBottle reserves the right to modify, suspend, or terminate the contest at any time for any reason, including but not limited to fraud, technical failures, or other circumstances beyond its control.

  • In the event of termination, BlindBottle may, at its discretion, select winners from among eligible entries received up to the time of termination.

10. Governing Law

  • The contest is governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict of law provisions.
